ARTICLE 2: PURPOSE
These GTC aim to define the terms of distance selling between the Seller and the Customer, from the order to services, including payment and delivery. They regulate all steps necessary for placing an order and ensure the follow-up of this order between the contracting parties.
ARTICLE 3: PRODUCTS
3.1 Characteristics The products offered for sale are those listed on the website on the day of consultation by the Customer. DIOLATA takes the utmost care in presenting the products (Ube, Superfruits, related products for preparation or in the same sales area) and guarantees their 100% natural and organic nature (subject to certification).
3.2 Packaging and Wrapping (Technical Specifications) Concerned about the environment and sanitary quality, DIOLATA guarantees specific packaging described as follows:
- Eco-responsible sachets: Composed of a laminate of Kraft paper and PLA material (bio-based polylactic acid), without traditional petrochemical plastic.
- Jars: Made of recyclable frosted glass, sealed with an Iron Lid. Watertightness is ensured by a technical PVS plastisol seal. The Seller guarantees that this seal is designed to ensure a hermetic closure without direct contact with the powder, thus preserving the purity of the product.
3.3 Availability Products are offered within the limits of available stock. In case of unavailability after placing an order, the Customer will be informed by email and will be refunded without delay.
ARTICLE 4: PRICE
The prices of products are indicated in Euros (€), or the currency of the buyer's country, all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the legal VAT rate will automatically be reflected in the price of the products. Prices do not include delivery costs, which are billed in addition and indicated before the order is validated.
ARTICLE 5: ORDER
The Customer can place an order on the website 24/7. The ordering process includes the following steps:
1- Selection of products and addition to cart.
2- Validation of cart contents.
3- Identification on the site or registration.

5- Choice of payment method and acceptance of the GTC.

ARTICLE 6: PAYMENT
Validating the order implies that the Customer is obliged to pay the indicated price. Payments for purchases are made by the means available on our website such as: Bank Card, Paypal, etc. The card is debited at the time of order validation. DIOLATA uses a secure payment system guaranteeing the confidentiality of banking data.
ARTICLE 7: DELIVERY
Products are delivered to the delivery address indicated during the order process.
- Deadlines: The deadlines indicated when ordering are average times corresponding to processing and delivery.
- Responsibility: Risks are borne by the purchaser from the moment the products have left DIOLATA's premises or its logistics provider. In case of damage during transport (broken jar, pierced sachet), a reasoned protest must be made to the carrier within three days of delivery.
ARTICLE 8: RIGHT OF WITHDRAWAL AND RETURNS
8.1 Legal Period In accordance with the provisions of Article L.221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of their products to exercise their right of withdrawal without having to justify reasons or pay a penalty.
8.2 Exception (Hygiene and Health) CAUTION: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection. Therefore, any opened Kraft/PLA sachet or any jar whose seal (plastisol seal) has been broken cannot be returned or refunded.
8.3 Return Procedures For unopened and sealed products, return costs are the responsibility of the Customer. Reimbursement will be made within 14 days after receipt and verification of the products by DIOLATA.
ARTICLE 9: WARRANTIES
All products supplied by the Seller benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). In case of non-conformity of a sold product (expired product upon receipt, reference error), it may be returned, exchanged, or refunded.
ARTICLE 10: LIABILITY
DIOLATA cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered (if outside France). It is the Customer's responsibility to check with local authorities the possibilities of importing or using the products or superfoods. Furthermore, DIOLATA cannot be held responsible for damages resulting from improper use of the purchased product (e.g., food intolerance not verified by the customer, overdose).
